Mediation and arbitration are both forms of ADR but use different methods. Arbitration is closer to a trial, with a neutral third party hearing testimony from the parties and reviewing the evidence before issuing a binding decision. In mediation, the mediator acts more like a guide, explaining the relevant laws to the parties and facilitating negotiation toward a settlement.

Since I am certified in both types of ADR, I can effectively advise and prepare clients no matter which type is being used. I know how to use mediation and arbitration to the client’s best advantage. Successful usage of ADR helps clients reach a reasonable, practical outcome. It also gives them a feeling of having participated in the resolution process, which tends to make the terms sustainable long-term.
